1. Respect for Intellectual Property

Proetix (“we,” “us,” “our”) is committed to upholding the intellectual property rights of others. All trademarks, logos, text, images, designs, and other content displayed on our website or used in connection with our products (“Content”) are protected by applicable copyright, trademark, and other intellectual property laws. No part of our Content may be reproduced, distributed, or used without the express prior written permission of the rights holder.

2. Prohibited Infringement

You may not upload, post, list for sale, or otherwise make available on Proetix any material that infringes the intellectual property rights of any third party. This includes, but is not limited to, unauthorized use of copyrighted works, trademarks, service marks, or trade dress.

3. Reporting IP Infringements (DMCA Takedown Procedure)

If you believe that your work has been copied or used on our site in a way that constitutes copyright infringement, or that your trademark rights are being violated, please send a written notice titled “IP Infringement Notice” to our Designated Copyright Agent (see Section 7). Your notice should include all of the following:

  1. Identification of the Infringed Work
    • A description of the copyrighted work or trademark you claim has been infringed.
    • The exact URL(s) or product listing name(s) on Proetix where the allegedly infringing material appears.
  2. Owner’s Contact Information
    • Your full name, mailing address, telephone number, and email address.
  3. Good-Faith Statement
    • A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the rights owner, its agent, or the law.
  4. Accuracy & Authorization Statement
    • A statement that the information in your notice is accurate and, under penalty of perjury, that you are the rights owner or authorized to act on behalf of the owner.
  5. Signature
    • A physical or electronic signature of the rights owner or an authorized agent.

4. Investigation and Response

Upon receipt of a valid infringement notice, Proetix will promptly:

  • Review and investigate the claim.
  • Remove or disable access to the allegedly infringing material if the claim appears valid.
  • Notify the user who posted or listed the material of our action.

In cases of copyright claims governed by the DMCA, the user may submit a counter-notice if they believe the removal was in error.

5. Repeat Infringers & Account Termination

Proetix reserves the right to terminate, in its sole discretion, the access or user accounts of any repeat infringer. Users whose listings or content are removed for infringement may have their seller privileges suspended or revoked.

6. False Claims Warning

Anyone knowingly submitting a false or misleading infringement notice may be held liable for damages, including costs and attorneys’ fees, under applicable laws.
